(US Single Copy License for Envoy Plug-In Component for Netscape Navigator)
Before proceeding with installation, you must indicate your willingness to accept the terms of the following Software License Agreement.
SOFTWARE LICENSE AGREEMENT
Grant of Rights
Tumbleweed hereby grants you a non-exclusive license to make and use unlimited copies of the accompanying Envoy Plug-In Component software product for Netscape Navigator (Software) on one (1) computer; distribute copies to other persons or entities provided each copy contains this Agreement and the same copyright and other proprietary notices that appear on the Software; and make an archival copy of the Software. This Agreement supersedes any prior version license.
Restrictions
You may not rent or lease the Software without the written permission of Tumbleweed. You may not decompile, disassemble, reverse engineer, copy, create a derivative work, or otherwise use the Software except as stated in this Agreement.
LIMITED WARRANTY/LIMITATION OF LIABILITY THIS SOFTWARE IS LICENSED AS IS. THIS WARRANTY IS IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL TUMBLEWEED BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF TUMBLEWEED OR AN AUTHORIZED TUMBLEWEED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow excluding or limiting implied warranties or limiting liability for incidental or consequential damages, and some jurisdictions have special statutory consumer protection provisions that may supersede this limitation of liability. As a result, these limitations may not apply to you if prohibited by the laws of your jurisdiction.
General
Any provision of this Agreement found to be unlawful, void, or unenforceable shall be severed from this Agreement and will not affect the validity and enforceability of any of the remaining provisions. This Agreement shall be governed by the laws of the State of California.
Export
You acknowledge that the laws and regulations of the United States restrict the export and re-export of the Software. You agree that you will not export or re-export the Software in any form without first obtaining written approval from Tumbleweed and the appropriate United States and foreign government approvals.
U.S. Government End Users
The Software is a"commercial item," as that term is defined at 48 C.F.R. 2.101 (OCT 1995), consisting of "commercial computer software" and "commercial computer software documentation," as such terms are used in 48 C.F.R. 12.212 (SEPT 1995) and is provided to the U.S.Government only as a commercial end item. Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4 (JUNE 1995), all U.S. Government End Users acquire the Software with only those rights set forth herein.
